This website, dieselleds.com (the “Site”), is operated by LED Illuminations LLC, a North Carolina limited liability company doing business as “Diesel LEDs” (“Diesel LEDs,” “we,” “us,” or “our”). References to “Diesel LEDs” include LED Illuminations LLC and its members, officers, employees, and agents. By accessing the Site or buying from us, you agree to these Terms of Service and to the policies referenced in them, including our Privacy Policy, Refund Policy, Shipping Policy, and Warranty Policy. If you do not agree to these Terms, please do not use the Site or place an order.
Please note: Section 16 contains a binding arbitration agreement and a class-action waiver that affect your legal rights. Read it carefully.
You confirm that you are at least the age of majority in your state or province of residence, or that you have the consent of a parent or guardian, and that the information you provide to us is accurate and complete.
All prices are stated in U.S. dollars and may change at any time without notice. We work to keep the Site accurate, but product descriptions, pricing, images, and availability can occasionally contain errors or omissions. We may correct any such error and update information at any time without prior notice, including after you have submitted an order.
We may refuse, limit, or cancel any order at our discretion — including orders that appear to be placed by dealers or resellers, or that we reasonably believe to be fraudulent. If we cancel an order after your payment method has been charged, we will refund that charge to your original payment method. Colors shown on the Site may differ from the actual product depending on your screen.
Many of our products — including LED headlight and other forward-lighting bulbs — are sold for off-road, racing, or show use only. These products are not certified to Federal Motor Vehicle Safety Standard No. 108 (FMVSS 108) and are not legal for headlight or forward-lighting use on vehicles driven on public roads. Where a product carries this limitation, it is stated on the product page.
You are solely responsible for knowing and following all federal, state, provincial, and local laws that apply to your vehicle and its lighting, and for determining whether a product is legal for your intended use. By purchasing, you acknowledge these limitations and accept full responsibility for how you install and use the product. We are not responsible for any fines, penalties, failed inspections, citations, or other consequences that result from using our products in a way that conflicts with applicable law or with this notice.
Our products are aftermarket automotive parts that you install yourself or have installed by others. You are responsible for choosing the correct product for your vehicle, confirming fitment, and ensuring proper installation, including professional installation where appropriate. We are not liable for incorrect product selection or installation, for damage to your vehicle or its electrical system, or for any injury, loss, or damage arising from installation or from use that conflicts with the compliance notice in Section 3. You assume all risks associated with installing and using our products.
We offer a limited warranty on our products as set out in our Warranty Policy, which is available on the Site and incorporated into these Terms by reference. The Warranty Policy explains what is covered, the warranty period for each product, what is excluded, and how to file a claim. Our warranties are limited warranties. This warranty gives you specific legal rights, and you may have other rights that vary from state to state and province to province.
The Site and its content are provided on an “as is” and “as available” basis. We do not warrant that the Site itself will be uninterrupted, secure, or free of errors.
Nothing in these Terms disclaims an implied warranty where the law does not allow it. Where we provide a written warranty on a product, any implied warranties on that product — including the implied warranties of merchantability and fitness for a particular purpose — are limited in duration to the length of the applicable written warranty in our Warranty Policy. Some states and provinces do not allow limits on how long an implied warranty lasts, so this limitation may not apply to you.
To the fullest extent permitted by law, Diesel LEDs will not be liable for any indirect, incidental, special, punitive, or consequential damages of any kind — including lost profits, lost savings, loss of data, or damage to your vehicle — arising from your use of the Site or any product. To the fullest extent permitted by law, our total liability for any claim relating to a product or to your use of the Site will not exceed the amount you paid for the product that gave rise to the claim. Some states and provinces do not allow certain limitations, so parts of this Section may not apply to you.
You agree to indemnify and hold harmless Diesel LEDs and its members, officers, employees, agents, and suppliers from any claim or demand, including reasonable attorneys’ fees, that arises out of your breach of these Terms, your violation of any law, or your violation of a third party’s rights.
Purchases are subject to our Refund Policy and Shipping Policy, both of which are incorporated into these Terms by reference.
If you send us comments, reviews, ideas, or other submissions, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and publish them in connection with our business. You are responsible for your submissions, and they must not be unlawful, infringing, or misleading. We may — but are not required to — monitor, edit, or remove content at our discretion.
You may not use the Site or our products for any unlawful purpose, to break any law or regulation, to infringe anyone’s intellectual property, to transmit malicious code, to collect other people’s personal information, to send spam or scrape data, or to interfere with the security of the Site. We may end your access for violating these Terms.
The Site may link to or rely on third-party websites and tools that we do not control. We provide them “as is,” without warranties, and we are not responsible for their content or practices. Your use of any third-party service is at your own risk and is governed by that party’s terms.
Your submission of personal information through the Site is governed by our Privacy Policy.
We may update these Terms at any time by posting the revised version on this page; your continued use of the Site after we post changes means you accept them. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. These Terms, together with the policies referenced in them, make up the entire agreement between you and us. We may assign these Terms; you may not. We are not responsible for any delay or failure caused by events beyond our reasonable control. You agree that we may communicate with you electronically.
These Terms, and any dispute arising out of or relating to them or to any product you purchase, are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. Subject to the arbitration agreement in Section 16, the exclusive venue for any permitted court action is the state or federal courts located in Buncombe County, North Carolina, and you consent to personal jurisdiction there.
Please read this Section carefully — it affects how disputes between us are resolved. Most issues can be settled quickly: before starting an arbitration, you agree to first contact us at dieselleds@gmail.com and give us 30 days to try to resolve the matter informally.
If we cannot resolve a dispute informally, you and Diesel LEDs agree that any dispute arising out of or relating to these Terms, the Site, or any product will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court — except that either party may bring an individual claim in small-claims court if it qualifies. The arbitration will take place in Buncombe County, North Carolina or, at your election, by phone or video or in your home county.
Class-action waiver: You and Diesel LEDs agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person’s claims. You and Diesel LEDs each waive any right to a jury trial.
Your right to opt out: You may opt out of this arbitration agreement within 30 days of your first purchase after this Section takes effect by emailing dieselleds@gmail.com with your name and a statement that you opt out of arbitration. Opting out will not affect any other part of these Terms.
